By engaging our services, you represent and warrant that:

You are at least 18 years of age
You have legal authority to pursue the judgment or request background screening
All information you provide is accurate, complete, and lawfully obtained
You will use background screening results only for permissible purposes

4. Fair Debt Collection Practices Act (FDCPA) Disclosure

Depending on the nature of the engagement, the Company may be deemed a debt collector under the Fair Debt Collection Practices Act (FDCPA).

Disclosure:

This communication is from a debt collector. Any information obtained will be used for the purpose of collecting a debt.

The Company complies with all applicable federal and state debt collection laws.

5. Background Screening Compliance (FCRA)

Background screening services are provided in compliance with the Fair Credit Reporting Act (FCRA) and applicable state laws.

Clients requesting background screening services certify that:

They have a permissible purpose under the FCRA
They have obtained all required disclosures and authorizations
They will comply with pre-adverse and adverse action requirements
Results will not be misused or unlawfully disclosed

The Company is not responsible for Client misuse of screening data.

6. No Guarantee of Results

The Company makes no guarantees regarding:

Successful recovery of judgments
Location of assets or debtors
Accuracy or completeness of third-party or public record data

Results depend on factors beyond the Company’s control.

7. Fees, Costs, and Payment

Fees are disclosed in written agreements or engagement letters
Certain services may require advance payment or contingency arrangements
Court costs, filing fees, levy fees, and third-party expenses are the Client’s responsibility
Failure to pay may result in suspension or termination of services

All fees are non-refundable unless expressly stated otherwise in writing.

8. Confidentiality

The Company maintains confidentiality of Client information and screening data, subject to:

Legal and court-ordered disclosures
Authorized third-party service providers
Regulatory compliance obligations

Clients are responsible for safeguarding reports and data provided.

9. Limitation of Liability

To the maximum extent permitted by law:

The Company shall not be liable for indirect, incidental, consequential, or punitive damages
Total liability shall not exceed the amount of fees paid for the specific service giving rise to the claim

10. Indemnification

You agree to indemnify and hold harmless the Company, its owners, officers, employees, and agents from any claims, damages, or liabilities arising from:

Misuse of background screening reports
Unauthorized or unlawful judgment enforcement activities
False or misleading information provided by you

11. Intellectual Property

All website content, logos, text, and materials are the intellectual property of the Company and may not be reproduced without written permission.

12. Third-Party Services and Data Sources

The Company relies on third-party databases, courts, and public records. We do not control these sources and are not responsible for inaccuracies, delays, or omissions.

13. Termination of Services

The Company reserves the right to terminate services:

For nonpayment
For suspected unlawful use
For violation of these Terms
Where continuation would violate law or ethics

14. Governing Law and Venue

These Terms shall be governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Venue shall lie exclusively in South Carolina courts.

15. Dispute Resolution

At the Company’s discretion, disputes may be resolved through mediation or binding arbitration in South Carolina, except where prohibited by law.
